As a service to our members, we offer Mediation Services for buyers and sellers who are in a dispute (usually over a deposit issue or lack of disclosure). We can conduct mediations in a matter of weeks if all parties agree. This program utilizes our experienced brokers as mediators. We have had great success with this program and find it to be very cost effective for the parties involved.
Buyer & seller disputes
(Cost ranges from $650 to $750 per party)
If a buyer and seller are in a dispute they can utilize our dispute resolution service to quickly resolve their issue. A buyer and seller dispute concerning the deposit money in escrow or a lack of disclosure, are among the types of cases we process.
Requirements
Mediation is the required dispute resolution agreement for buyers and sellers in the RPA. This Mediation Program meets the requirements to Mediate in the RPA. If the Dispute is $10,000 or less, parties may use Small Claims Court instead of mediation. Please review the fee schedule since the fees vary depending on the claim amount.
Procedure
Once a mediation request is filed against the Respondent, we will contact the Respondent to see if they agree to mediate using our facilities. The complainant must provide us with a current contact address for the Respondent. Agents and/or attorneys may appear with their clients at the mediation hearing. Our highly trained mediators are all brokers with many years of experience. The goal of the mediator is to help the both parties reach a mutual agreement. If an agreement is not reached at the mediation, both parties are free to file an arbitration (if the arbitration agreement is initialed by both parties on the RPA) through an outside arbitration source such as the American Arbitration Association or Judicial Arbitration and Mediation Services (JAMS).
